In short
- An online store needs the appropriate sales-tax account in states where its actual activities require registration. For a planned New York taxable business, the state specifies a 20-day registration lead; Texas charges no permit application fee, though it can require a security bond.
- Determine the state obligation and account category before applying. An out-of-state use-tax registration is not necessarily called a seller’s permit.
- Saving an application confirmation is different from receiving the authorization and setting the collection start date.
- Registration can create filing duties even when the shop has no sales. Keep the first return deadline with the permit record.
- AirPost is a peer-to-peer fulfilment network: online shops have their orders packed and dropped at a parcel point by verified people near their customers, who earn a fee per parcel from home. No warehouse, no minimum order volume.
Opening a tax account is a transition from identifying an obligation to operating it. The application needs accurate facts, the checkout needs the right settings, and somebody needs to file the resulting returns. A small shop can complete the form and still miss that handoff. This guide uses Texas, New York and California agency instructions checked on 14 October 2026 to show what to prepare. It does not assume that every shop must register in all three states.
Which states should your online store apply to first?
Start with the states where you operate and hold property, then review destination-state sales tests and marketplace rules. Write a reason beside every proposed registration. That reason might be your local retail activity, a particular stock arrangement or a sales-based trigger. Do not apply everywhere merely because your checkout can ship everywhere. At the same time, do not restrict the review to your home address if inventory or other activities take place elsewhere.
Keep required registration distinct from voluntary registration. California’s out-of-state retailer guide says an out-of-state business may be required to register and also describes voluntary Certificate of Registration–Use Tax registration when it is not required. That option is a separate decision with ongoing administration to consider. Preserve the basis for choosing it so the person filing returns understands why an account exists.
Review the retail channel without treating all sales as identical. Provider-collected marketplace sales and direct-store sales can lead to different collection and reporting responsibilities. Preserve the marketplace’s tax documentation, but do not use it as the reason to leave your direct checkout unreviewed. The registration record should say which channels and activities were considered, not simply that the business sells online.
Is a seller’s permit the same account in every state?
No. CDTFA’s permits and licenses page distinguishes a California seller’s permit from a Certificate of Registration–Use Tax issued to relevant out-of-state sellers. New York uses a Certificate of Authority. Texas uses a sales and use tax permit. Use the agency’s application path for the facts of your business instead of searching only for one familiar permit name. Store the exact account type beside the registration number.
| State example | Agency account or document | Specific preparation issue |
|---|---|---|
| Texas | Sales and use tax permit | Permit application has no fee; a security bond may be required |
| New York | Certificate of Authority | Plan the state’s registration lead and receipt of authorization before taxable operations |
| California out-of-state seller | Relevant seller’s permit or use-tax registration | Answer the location and activity questions under CDTFA definitions |
| Any state already on your ledger | Existing active account | Check status, reporting periods and permitted updates before creating a duplicate |
Keep registration and purchase-exemption documentation distinguishable. The New York Certificate of Authority authorizes tax collection and the issue or acceptance of most state exemption certificates, but the transaction still needs its appropriate document. A permit number entered on a supplier form does not replace checking whether the purchase is genuinely for resale or another qualifying exemption. Retain the actual certificate and the purchases it supports rather than filing only the permit application.
When should you apply before the first taxable sale?
New York’s registration bulletin says a business expecting to make taxable New York sales must register at least 20 days before beginning business, and cannot legally make taxable sales until it receives its Certificate of Authority. This is a planned-start rule, not permission to postpone action after discovering an existing obligation. A remote seller newly meeting nexus must follow the applicable nexus instructions for that trigger.
Treat application submission, approval and the start of taxable operations as separate milestones. Save the confirmation and check what the state has actually issued. If the launch changes, review whether the application’s start information needs updating. Do not assume that an order scheduled for later dispatch is irrelevant to the collection review; ask which event the relevant state rules use for the retail transaction. Your packing schedule alone does not settle that timing.
New York distinguishes regular and temporary Certificates of Authority. Its temporary option concerns qualifying activity lasting no more than two consecutive sales tax quarters in a twelve-month period; show and entertainment vendors need a regular certificate. A normal ongoing webshop should not choose a temporary category merely because its initial stock batch is small. Review the expected business activity and the state’s conditions rather than using short-term fulfillment as a proxy for temporary retail operations.
What information should you assemble for the application handoff?
Prepare a factual registration packet before opening the form: the business’s legal identity, ownership or responsible-person information requested, operating addresses, product types and the planned or actual activity dates. Add the location of stock and the nature of any fulfillment relationship. Use information supported by your records. If the business already has an agency account, keep that identification available so you can assess whether an update rather than a new account is appropriate.
Document why the state is in scope
Retain the physical-activity or sales-based finding and relevant date. Identify whether registration is required or voluntarily chosen.
Choose the official application route
Match the account category to the agency’s definitions. Read the current instructions before describing premises or stock held by another person.
Save the submitted facts and response
Keep the confirmation, account type and any issued authorization. Record what remains unresolved rather than assuming approval from submission.
Assign collection and filing ownership
Name who updates checkout, reconciles receipts, submits the return and pays the agency. Save the first reporting deadline beside the account.
For local fulfillment, give the person preparing the registration the actual storage relationship, not just a platform name. Who owns the goods? Where are they held? Does the partner only pack and dispatch, or can it make retail sales? US fulfillment order routing helps define those operational questions. An application based on a vague description can produce the wrong account or leave a material activity undisclosed.
What does a free permit mean for your shipment budget?
The Texas Comptroller’s permit FAQ says there is no fee for a permit, although a security bond may be required. That does not mean tax administration or fulfillment is cost-free. Separate the agency’s application fee from any adviser’s charge, a potential bond requirement, operational expenses and tax you collect for remittance. An unsolicited paid registration offer is not evidence that the state charges the same amount.
On 14 October 2026, AirPost’s US domestic page showed a small USPS Ground Advantage package from approximately $7.78, including the platform fee and excluding the sender’s agreed fee. Its USD figures are converted display references; the page says settlement is in euros. Combining that dispatch reference with Texas’s $0.00 application fee gives $7.78 for those two budget components only. It leaves sender payment, any bond, advice and other expenses unresolved.
The calculation is deliberately limited: it prevents a free state application from being confused with free order handling or complete compliance costs. Obtain your actual shipment quote and your own registration requirements before budgeting. Customer sales tax belongs in a separate reconciliation, connected to the retail receipt and agency liability. Do not add tax collected to fulfillment margin merely because the funds arrive in the same payment settlement.
What filing duties remain during a quiet sales period?
Texas requires a sales and use tax return even when there are no taxable sales or purchases to report during the period. Save the filing frequency and deadline assigned to the account. A shop can have a quiet month while the tax account remains active. Place the zero-activity review in the same calendar as ordinary returns so that an empty order report leads to the appropriate filing decision instead of no action.
Keep each state’s account status separate from the storefront’s sales status. Closing a website checkout, suspending a product or removing a fulfillment location does not itself document an agency account closure. Review remaining activities and the state’s final-return or update process. If an adviser handles filings, send the operational change as a dated fact and obtain confirmation of the account action. The business record should show the agency outcome, not only your request.
Before the first filing, reconcile customer product receipts, delivery charges, exemptions, marketplace treatment and tax collected. Compare those categories with the state return instructions, keeping supplier label purchases outside the retail-sales total unless the rule calls for something different. Save the reconciliation and submission confirmation together. That record turns the permit from a document you once obtained into a tax account you can operate and explain.
Frequently asked questions
Does every online store need a sales tax permit in every state?
No. Identify the states where physical activities, sales-based nexus or other rules require registration. Consider existing and voluntary accounts separately.
Is a Texas sales tax permit free?
The agency says there is no permit fee, but it may require a security bond. A third party’s service charge is different from the agency’s application fee.
Can I start New York taxable sales immediately after applying?
The state bulletin says you cannot legally make taxable sales until you have received the Certificate of Authority. Plan its registration lead for a new taxable business.
Does an out-of-state California seller always need a seller’s permit?
The appropriate account depends on the business’s facts. CDTFA distinguishes seller’s permits and Certificates of Registration–Use Tax for relevant out-of-state sellers.
Must I file a Texas return when I have no sales?
The permit FAQ requires a return even when there are no taxable sales or purchases for the reporting period. Check the account’s assigned period and deadline.
