Can you be self-employed while on EI in Canada?

Check EI regular-benefit eligibility before packing parcels at home: the six minor-extent factors, unpaid setup time, job search and readiness for work.

In short

  • You may remain eligible for Canadian EI regular benefits while self-employed only if you meet the claim’s conditions, including a business involvement minor enough to qualify as unemployment. Service Canada considers 6 factors; neither a small profit nor a chosen weekly-hours limit guarantees eligibility.
  • Count the work involved in setting up and operating the service, including unpaid activity, when describing your business participation.
  • You must remain available for suitable work and continue an appropriate job search while receiving EI regular benefits.
  • Eligibility comes before calculating the earnings deduction. Signing up for AirPost is not an EI-approved self-employment program.
  • AirPost is a peer-to-peer fulfilment network: online shops have their orders packed and dropped at a parcel point by verified people near their customers, who earn a fee per parcel from home. No warehouse, no minimum order volume.

Why is low parcel income not enough to keep EI?

EI regular benefits depend on being unemployed and meeting availability requirements. For a person operating a business or controlling their own working hours, the rules assess the extent of that involvement. A business can demand substantial work before producing much profit. Service Canada therefore needs more than a payout total. Describe what you do, the time and resources involved and what happens if another employer offers suitable work.

Employment Insurance Regulations section 30 creates a presumption of a full working week for the specified self-employment or business situations. Its exception concerns work so minor that a person would not normally rely on it as a principal means of livelihood. The six-factor assessment determines whether that exception applies. The fact that you personally call the activity a side hustle does not answer the statutory question.

What are the six factors for a home parcel service?

Official factorWhat a sender should describeEvidence to retain
Time spentReceiving stock, packing, drop-offs, customer discussions and business administrationDated activity log, including unpaid work
Capital and resources investedEquipment, workspace and other resources you commit to operatingOwnership records, invoices and workspace description
Financial success or failureWhat the service earns and costs, and how the business is developingFee agreement, earned-income ledger and expense records
ContinuityWhether there is an ongoing arrangement and continuing responsibilitiesStock commitments, customer agreement and work schedule
Nature of the activityThe services you supply and how the business operatesDescription of packing, storage and drop-off obligations
Intention and willingness to seek and immediately accept other workYour job search and your ability to take suitable employmentApplications, interview records and a realistic handover arrangement
The factors come from EIR 30 and Service Canada’s guidance. The sender examples are an evidence worksheet, not a scoring system or approval checklist.

Service Canada’s Digest says all six factors must be considered. Time matters, but it is not the only test. A business with few logged packing minutes can still involve ongoing obligations or substantial resources. Conversely, one equipment purchase cannot determine the result on its own. Give a complete description instead of selecting the single fact that makes your activity appear smallest.

Does unpaid setup or finding a shop count as business activity?

The Digest includes efforts to set up or continue a business when assessing time spent. Before the first fee arrives, you may be arranging storage, discussing services, setting up the printing process or preparing to receive stock. Record those activities when they form part of establishing or operating your business. A week with no withdrawal is not evidence that you did no work.

Keep enough detail to explain the activity without inflating or hiding it. Note what you did and when, separating business work from personal tasks. If you pack in the evening, the time of day can be relevant, but evening work is not automatically minor. Service Canada compares the nature and extent of the activity with how such work is normally carried on. A flexible schedule does not by itself establish unemployment.

Describe any change during the claim. Initial preparation, receiving the first batch and carrying out ongoing orders can involve different commitments. A decision based on an early stage does not make later expansion irrelevant. Retain the updated agreement and activity records when you change the service, take on ongoing storage obligations or alter the times when you can accept other employment.

How should you describe stock that still belongs to the shop?

AirPost’s copy says a shop sends products and packaging and retains ownership of its stock. Explain that ownership when describing the resources committed to your business. The goods’ retail value is not automatically capital you invested. Your own equipment, space and time still need to be described, as do the responsibilities that come with holding goods for another party. Shop ownership does not eliminate your participation in the service.

Transport spending also needs a clear owner. The AirPost Canada-to-Canada page retrieved on 14 October 2026 displayed approximate Canada Post prices of C$15.85 for a medium parcel and C$33.67 for a large parcel, including the label platform fee and excluding the sender fee. Adding those displayed prices gives C$49.52. If the shop buys the labels directly, that amount describes its shipping expenditure, not your invested capital or packing revenue. The calculation compares published prices without forecasting orders.

That accounting distinction does not decide the time factor. Accepting an order, printing its label, packing and dropping it off are activities described in AirPost’s sender copy. Tell Service Canada how those tasks fit into your week, including related handling or administration you actually perform. A transport charge appearing on someone else’s account does not mean the parcel took none of your time.

What if the business is temporarily quiet or unprofitable?

The Digest says slow periods and seasonal fluctuations do not automatically make the activity minor. Continuing business responsibilities and the intention to keep operating remain relevant. For a home sender, a quiet period may still involve holding the shop’s stock, maintaining the service and communicating about future orders. Describe the actual obligations rather than treating the absence of outbound parcels as the absence of business involvement.

Keep the financial information in context. A revenue ledger helps show earnings, but a temporary loss can coexist with substantial setup or operating work. Financial success or failure is one of the six factors, so supply both the amounts and the explanation of the activity. Do not change the name of your work to volunteering merely because the first period earns little; its business nature and your participation still need assessment.

Could you accept a suitable job immediately?

For EI regular benefits, you must remain ready, willing and capable of working and make reasonable ongoing efforts to find suitable employment. Service Canada’s job-search guidance says part-time work does not remove that duty. Document applications, employer contacts, interviews and results as appropriate to your circumstances. Looking for more parcel customers is business development; it does not on its own document a search for other employment.

Test your availability against the agreement you actually have. Would a standing drop-off commitment conflict with a new employer’s hours? Could stock be returned or another arrangement be agreed if you start employment? The Digest recognizes that credible evidence of someone taking over can support a claim of availability. It does not promise that naming a substitute guarantees entitlement. Any proposed handover must be realistic and consistent with the shop’s agreement.

Do not promise a shop obligations you cannot reconcile with your claim. Agree what happens when your availability changes, rather than assuming you can abandon its stock or accepted orders. Keep the written arrangement available for Service Canada to review. You can then explain your ability to accept suitable employment using actual terms, instead of a general statement that you would somehow find time.

Is voluntary self-employed EI registration the same protection?

The separate self-employed EI program concerns special benefits, such as maternity, parental or sickness benefits, rather than ordinary coverage when your independent orders disappear. Its eligibility page requires the agreement to have been active for at least twelve months before special benefits can be received, along with the other qualifying conditions. Joining that program is a separate choice; it is not a shortcut to keeping a current regular-benefit claim.

There is also a distinction between independently starting a business and a self-employment activity formally approved under an authorized employment program. The Digest explains the special treatment for an approved referral. Opening a sender account or agreeing work with a shop does not establish that approval. If you are considering a referred program, confirm its actual status with the appropriate authority before relying on that exception.

What should you tell Service Canada before the first batch?

  1. Describe the service and relationship

Explain stock ownership, the tasks you will perform, the fee agreement and any continuing responsibilities.

  2. Describe resources and activity

Provide realistic information about workspace, equipment, preparation and operating time.

  3. Explain availability

Show your job-search efforts and how you can immediately accept suitable employment.

  4. Confirm the reporting procedure

Ask how to report the business activity, service earnings and documented operating expenses for your claim.

  5. Keep the decision and update changes

Retain the guidance and provide updated facts when the extent or obligations of the business change.

Once eligibility is established, the EI Working While on Claim calculation explains the separate earnings deduction. The Canadian T2125 guide covers annual tax records. Read AirPost’s sender arrangement before proposing the service, so the information you give Service Canada matches the work you would actually undertake.

Frequently asked questions

Can I be self-employed while on EI regular benefits?

Potentially, if the involvement is minor in extent and you meet the other claim conditions. Service Canada considers six factors, including your ability and willingness to seek and immediately accept other employment.

How many hours can I work in my business while on EI?

There is no universal safe weekly-hours number in the six-factor test. Report the actual work and consider the resources, continuity, nature, finances and availability factors as well.

Do I report self-employment if I have not been paid?

Describe the business activity and follow the reporting instructions even when payment is later. Setup and operating efforts can matter to the extent-of-involvement assessment.

Does a business loss mean I can keep EI?

Financial success or failure is only one factor. A loss or slow period does not automatically establish that the business activity is minor.

Does self-employed EI registration cover a lack of parcel orders?

The voluntary self-employed program provides qualifying special benefits, rather than ordinary unemployment coverage for a fall in independent orders. Its eligibility rules include a twelve-month agreement period.
